Our client is looking to recruit a Solicitor for their Education team.
Typical role responsibilities:
Supporting both our School Support Service team and the Academy Conversion team, advising on a range of legal issues and undertaking transactional work.
Advising on education law including the statutory and regulatory framework relating to maintained schools and academies.
Undertaking the legal steps necessary for schools to become academies, with particular emphasis on the governance of multi academy trusts, funding agreements, TUPE and the transfer of assets and liabilities.
Advising on employment matters, including contracts, national terms and conditions, policies, disciplinaries and complaints, redundancy and restructuring, TUPE and dismissal.
Advising on exclusions from schools including advising on the statutory guidance and the statutory review procedure.
Advising on admissions to schools and academies including reviewing admissions arrangements, the application of the Admissions Code and advising on referrals to the adjudicator and defending judicial review claims by disappointed applicants.
Advising on Special Educational Needs issues including claims relating to disability discrimination and the funding of special schools.
Dealing with parental complaints and advising on possible action against aggressive parents.
Advising on and drafting typical commercial contracts to be entered into by schools.
Advising on and drafting appropriate contracts allowing schools to collaborate, including establishing teaching schools and schools companies.
Advising on both corporate and charitable governance, including best practice for trustees in relation to duties and responsibilities, drafting Articles of Association and Schemes of Delegation.
Establishing companies and advising those undertaking the role of company secretary.
Advising on school organisation, including establishing new schools and opening schools on satellite sites.
Advising on information requirements for schools, including duties under FOIA and the DPA and referrals to the ICO.
Keeping our systems up to date and capturing know-how about our clients and areas of the practice.
Supporting our team with marketing / business development opportunities, including tenders, client presentations and client seminars.

We are looking for an experienced qualified solicitor or legal executive who is committed to working in the Education sector, reporting to the Head of Education.
The successful candidate will have a strong academic background and be intelligent and organised in their approach. Previous experience advising schools and colleges, whether from a local authority background or private practice, is essential, as is the ability to cope with an intellectually stimulating and demanding workload. Excellent written and oral communication skills are important, as to the ability to be supportive towards clients and work in a team. We are looking for a key member of the team who is enthusiastic, self-motivated and willing to work hard.
The successful candidate will ideally have experience advising schools on a range of matters including academy conversion, capital projects, free schools and school expansion. Candidates with experience of advising schools on employment law matters, including TUPE transfers, grievance and disciplinary processes, HR policies, pay progression, settlement agreements and negotiating with trade unions, will be especially welcome.
